CALIFORNIA'S PROPOSITION 65

If A Product Carries A Proposition 65 Warning, Is It Unsafe?
The sole purpose of Proposition 65 is to notify consumers that they are being exposed to chemicals that are known to cause cancer and/or reproductive toxicity. A Proposition 65 warning, however, does not indicate that a product is in violation of any product-safety standards or requirements – furthermore, it does not mean that a product is in itself unsafe. Other state public health officials and federal government agencies are responsible for regulating product safety. For example, the California Department of Public Health issues recalls food products found to be unsafe. The federal U.S. Food and Drug Administration regulates food, drug, cosmetic and medical device products. Other types of consumer products, including toys, jewelry, personal care products, and other non-food items, are regulated by the federal Consumer Product Safety Commission, which also may issue recalls for products found to be unsafe. MFINITY Global products are not deemed unsafe or in violation of any Federal or State guidelines by any of these agencies.
If MFINITY Global Products Are Not In Themselves Unsafe, Why Then, Is A Warning Label Required?
The California Office of Environmental Health Hazard Assessment looks at potential cumulative effects of chemical exposures that may come to a consumer from multiple sources over long periods of time to assist in establishing warning thresholds. That is, if a consumer is using several products that expose them to a single chemical, the potential negative effect(s) may be cumulative; therefore, the consumer may choose to forgo an individual product if that particular chemical is of concern.
How Are The Warning Thresholds Calculated?
For carcinogens, the threshold for requiring a warning is the level at which a person exposed to the chemical at this level for 70 years would have a one in 100,000 chance of developing cancer as a result of that exposure. For developmental toxins (birth defects or other reproductive harm), this is the level at which a chemical would have no observable effect assuming exposure at 1,000 times that level.
Does This Mean That There Is Contamination Or Impurities In MFINITY Global Products?
No. The mandate includes naturally occurring and organic substances as well as man-made variants of the chemicals from California’s Proposition 65 list. A full list of those chemicals can be found at the following link: http://oehha.ca.gov/prop65/prop65_list/Newlist.html
Are These Labels Required In Any State Other Than California?
No. Other states rely on the various State and Federal Consumer Protection agencies to regulate food and product safety. MFINITY Global products are not deemed unsafe or in violation of any Federal or State guidelines by any of these agencies.
